Witness preparation is important because witnesses are usually inexperienced in answering questions in a high-stress environment. Some of the most difficult questions for witnesses to answer are the “yes” and “no” questions. Here are three tips for preparing witnesses for these types of questions.

1.One way of responding to a “yes” or “no” question is by saying, “I understand that this is a ‘yes’ or ‘no’ question, and I could answer it this way, but if I do my answer would be incomplete and possibly misleading.” This puts the opposing attorney in a predicament because the jury sees the witness as reliable and honest, and the attorney is not getting the answer they want.

2.Another way of answer a “yes” or “no” question is by answering the question with either “yes” or “no” and then adding, “under certain conditions.” This invites the opposing attorney to either leave the answer as it is or question what those conditions may be. This gives the opposition attorney an incomplete answer and puts them in a dilemma.

3.The third way a witness can answer a “yes” or “no” question is by saying, “as I understand your question, I would answer [‘yes’ or ‘no’].” This is an incomplete answer and leaves the attorney wondering in what way the witness understood their question.
